This Refund and Withdrawal Policy is an integral part of the Terms and Conditions and applies to every purchase made on www.mamethod.com.

1. Your statutory rights as a Consumer

If you are a Consumer or an Entrepreneur with consumer rights (Art. 7aa of the Polish Consumer Rights Act of 30 May 2014), you enjoy:

  • a 14-day right of withdrawal from any distance contract (Art. 27 PL Consumer Rights Act / Art. 9 Dir. 2011/83/EU);
  • a statutory right of conformity for any digital content or digital-service elements supplied with the Services (Chapter 5b PL Consumer Rights Act / Dir. (EU) 2019/770), and mandatory contractual remedies for live tuition services;
  • protection against unfair commercial practices and unfair contract terms (PL Civil Code Art. 385¹ ff.).

Nothing in this Policy limits or excludes rights granted to you by mandatory law.

2. 14-day right of withdrawal

2.1. Period

For service contracts (including online tuition), the 14-day period starts on the day the contract is concluded (Art. 28 pkt 2 of the Polish Consumer Rights Act / Art. 9 (2)(a) of Dir. 2011/83/EU). If the last day of the period falls on a Saturday, Sunday or statutory non-working day, the period ends on the next working day (Art. 115 of the Polish Civil Code).

2.2. How to withdraw

Send us, before the deadline, an unequivocal statement of withdrawal:

  • E-mail to [email protected] with subject "Withdrawal";
  • Postal letter to the registered office;
  • Online form in the Student Area (when available).

You may use the model form in Annex A below (not mandatory).

2.3. Effects of withdrawal

Subject to any proportional amount due for services already performed under § 3.2, we refund all payments received, including delivery costs (if any), within 14 days of receiving your notice. The refund is made using the same means of payment you used for the original transaction, unless you have expressly agreed otherwise. In any case you will not incur any fees as a result of the refund (Art. 32 of the Polish Consumer Rights Act / Art. 13 (1) of Dir. 2011/83/EU).

3. Starting lessons during the withdrawal period

The live, human-delivered tuition supplied by MA Method Academy is a service within the meaning of Directive 2011/83/EU (as amended by Dir. (EU) 2019/2161), not "digital content" merely because it is delivered through Zoom, Google Meet or the Student Area. Under Article 38 (1)(1) of the Polish Consumer Rights Act (transposing Art. 16 (a) Dir. 2011/83/EU), the right of withdrawal is lost for a service contract only if all of the following are met:

  1. you expressly request performance to begin before the 14-day withdrawal period; and
  2. you acknowledge that you will lose your right of withdrawal once the contract has been fully performed by the Provider; and
  3. the service is in fact fully performed by the Provider.

3.1. How we apply this rule

When you book your first lesson within the 14-day window, you will be shown the following text and asked to tick a dedicated checkbox; we record your acceptance and send you a confirmation by e-mail on a durable medium (Art. 21 of the Polish Consumer Rights Act / Art. 8 (8) Dir. 2011/83/EU):

"I expressly request that MA Method Academy begin to provide the lesson(s) under my contract before the 14-day withdrawal period expires. I acknowledge that I will lose my right of withdrawal only once the service ordered has been fully performed by MA Method Academy. If I withdraw after performance has begun but before the service ordered is fully performed, I will owe an amount proportional to the services already provided (§ 3.2)."
  • Subscription / Plan: starting or completing one or more lessons during the 14-day period does not by itself remove your right to withdraw from the Subscription. If you withdraw during that period, we deduct only the proportional amount for lessons already delivered or validly treated as performed before we receive your withdrawal notice (§ 3.2).
  • Lesson not delivered before we receive your withdrawal notice: no proportional charge is made for that lesson.
  • Trial lesson (EUR 9): because the Trial is a one-off service, once the Trial lesson is fully performed after your express request and acknowledgement, the right of withdrawal in respect of the Trial is lost.

3.2. Proportional refund

If performance has begun (with your express request under § 3.1) but is not complete when you withdraw, you owe us an amount proportional to the services already performed up to the moment you notify us of withdrawal, calculated by reference to the total contract price (Art. 35 of the Polish Consumer Rights Act / Art. 14 (3) of Dir. 2011/83/EU; Art. 57 of the Italian Codice del Consumo). For Subscriptions we apply the following formula for the billing cycle affected by the withdrawal:

amount due = total contract price × (lessons performed ÷ total lessons included in the Plan for the current billing cycle).

For this formula, "lessons performed" means lessons that were delivered, attended, or validly counted as performed under § 5 before we received your withdrawal notice. We refund the difference within 14 days of receiving your withdrawal notice.

4. Cancellation of a Subscription (outside the 14-day window)

You may cancel at any time from the Student Area or by e-mail to [email protected]. Cancellation takes effect at the end of the current monthly billing cycle. Until that date you remain entitled to use all lessons included in your Plan for that cycle; no further amounts are charged. Outside the 14-day withdrawal period, unused lessons within the current cycle are not refunded merely because you choose not to use them, but this does not affect refunds or remedies due under mandatory law, where lessons cannot be delivered through our fault, or where § 5 gives you a refund right.

5. Lesson-level cancellations

The following operational rules apply without limiting your 14-day withdrawal right or statutory conformity remedies.

6. Statutory conformity and complaints

Live tuition is a service. Digital materials, recorded feedback, account features and Student Area access may also include digital content or digital-service elements. If the Services do not conform to the contract you may, in order:

  1. request the Provider to bring them into conformity within a reasonable time, free of charge;
  2. if not remedied, request a proportional price reduction or terminate the contract and obtain a refund of the unused portion.

Send the conformity complaint to [email protected]. We respond within 14 days. For digital content or digital-service elements, Chapter 5b of the Polish Consumer Rights Act applies: for a one-off supply or a series of individual supplies, liability covers any lack of conformity that existed at supply and becomes apparent within 2 years from supply; for continuous supply, liability covers any lack of conformity that occurs or becomes apparent throughout the entire period during which the digital content or digital service is supplied (Art. 43l PL Consumer Rights Act / Art. 11 Dir. (EU) 2019/770). For live tuition services, your remedies under the Polish Civil Code, the contract and any mandatory consumer-protection rules of your country of habitual residence remain unaffected.

7. Refund mechanics

7.1. Refunds are made to the original means of payment.

7.2. Once we initiate a Stripe refund, the card issuer or bank may need additional processing time outside our control.

7.3. For B2B invoiced purchases, where a refund is due we issue a correction invoice (faktura korygująca) and refund within 14 days unless the parties have validly agreed otherwise.

7.4. Refunds in EUR. We are not responsible for currency-conversion variances.

8. Out-of-court dispute resolution

See § 12 of the Terms and Conditions. Consumers may turn to the Polish Trade Inspection (Inspekcja Handlowa), the local municipal/poviat consumer ombudsman (rzecznik konsumentów) or the bodies registered in the UOKiK ADR register at polubowne.uokik.gov.pl, and Italian-resident consumers may turn to the conciliation bodies recognised under Articles 141 to 141-decies of the Italian Codice del Consumo (D.lgs. 206/2005), as introduced by D.lgs. 130/2015. The European ODR platform established by Reg. (EU) 524/2013 was closed on 20 March 2025 and the Regulation was repealed by Reg. (EU) 2024/3228 with effect from 20 July 2025.
